Pfizer’s Viagra, a brand name for the drug that’s been in use for more than 20 years, is coming off patent a few months after being acquired by GlaxoSmithKline.
Pfizer Inc. has filed a lawsuit in the federal court in Florida alleging that Pfizer, maker of the drug Viagra, and its competitors have infringed on patents related to Viagra by selling a generic version of the drug that’s also approved by the Food and Drug Administration.
The lawsuit, filed Wednesday in federal court in Orlando, relates Pfizer’s recent acquisition of the company’s off-patent rights in a new drug formulation called “Sildenafil.”
The drug is a medication used for the treatment of erectile dysfunction. It works by increasing blood flow to the penis. As a result, it can help men get and keep an erection when sexually aroused.

NEW YORK (AP) —A federal judge in New York ruled Friday that a pharmaceutical company has agreed to pay more than $1 billion in penalties and forfeiture, while other companies and individuals are being held to the same punishment, which would be a maximum of $2.5 billion.
Under a consent decree the court agreed to pay the company $750 million to settle claims it engaged in a marketing fraud and overcharged the company with misbranding Viagra.
The company, GlaxoSmithKline Plc and Mylan, said in a statement that they were "pleased" with the settlement. However, they said the company has reached a settlement with other companies and individuals.
The court ruled that the settlement is a "no-go" because "it was entered in good faith and was not anticompetitive."
The settlement was announced by the company's CEO, Dr. John Chazal, who was named as a defendant in the suit.
Chazal, who is the executive chairman of the company, is a former president of the American Diabetes Association and a former president of the National Heart, Lung and Blood Institute.
The court noted that GlaxoSmithKline has filed a lawsuit against GlaxoSmithKline over its marketing practices that were the product of a marketing fraud.
The suit also alleges that GlaxoSmithKline engaged in the marketing of its products in violation of federal law. GlaxoSmithKline also is in the United States to resolve a trademark infringement lawsuit filed by Pfizer Inc.
The suit, filed in New York state, claims that the company's marketing practices were based on false, misleading claims that the company was marketing Viagra and had used misleading advertising materials, including misleading statements about the risks associated with using a "generic" product for erectile dysfunction.
The suit also alleges that GlaxoSmithKline's marketing practices violated federal and state antitrust laws, and that it violated the FTC Act by paying kickbacks and fines to individuals for misbranding and misleading marketing practices.
The suit seeks the full $750 million of penalties and forfeiture as well as a $2.5 billion fine and other forfeiture of the company and individuals who have used the marketing fraud.
According to the settlement, the company will pay $2.5 billion in forfeiture to the company's shareholders.
The company's attorney, Michael S. Krumholz, said the agreement was "not a fair and fair settlement." He said he was disappointed by the judge's decision.
In an emailed statement, GlaxoSmithKline said in part, "We are pleased to have agreed to pay $750 million to resolve our trademark and copyright cases."
